End User License Agreement

This End User License Agreement ("Agreement") is between you and LunarLife, Inc., a Delaware corporation ("LunarLife," "we," "our," or "us"), and governs your use of the LunarLife mobile application (the "App"). This is a custom EULA that supplements, and does not replace, Apple's standard licensed-application end-user agreement terms where applicable.

 

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App. You must be 18 years or older to use LunarLife.

 

1. Acknowledgement

 

You acknowledge that this Agreement is between you and LunarLife, Inc. only, and not with Apple, Inc. ("Apple"). LunarLife, Inc., not Apple, is solely responsible for the App and its content.

 

2. Scope of License

 

LunarLife, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device you own or control, as permitted by the Usage Rules in Apple's App Store Terms of Service, for your personal, non-commercial use. You may not distribute, sublicense, rent, lease, lend, or sell the App.

 

3. Nature of the Service

 

LunarLife provides a Personal Decision and Timing Intelligence experience: personalized insights derived from celestial and environmental data, your own self-reported information, and AI-generated interpretation. LunarLife does not predict the future and does not provide medical, mental health, financial, legal, or relationship advice. It is not a diagnostic or treatment tool. If you are in crisis, contact a qualified professional or emergency services.

 

4. Maintenance and Support

 

LunarLife, Inc. provides support for the App at support@lunarlife.me. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.

 

5. Warranty

 

LunarLife, Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be LunarLife, Inc.'s sole responsibility.

 

6. Product Claims

 

LunarLife, Inc., not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

 

7. Intellectual Property Claims

 

LunarLife, Inc. acknowledges that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, LunarLife, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

 

8. Legal Compliance

 

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms

 

Your use of the App must comply with any applicable third-party agreement, including your wireless data service agreement, which may impose fees or restrictions on your use of the App.

 

11. Third-Party Beneficiary

 

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of this Agreement.

 

12. Data Collection

 

Your use of the App is subject to our Privacy Policy, which describes what information we collect, how we use it, and your rights. Please review it before using the App.

 

13. Compatibility Check

 

If you use the Compatibility Check feature, you represent that you have the permission of any third party whose name or birth information you submit. See our Privacy Policy and Terms of Use for details.

 

14. Subscriptions and Fees

 

The App offers auto-renewing subscriptions processed through the App Store. See our Terms of Use and Refund Policy for subscription and cancellation terms.

 

15. Relationship to the Terms of Use

 

Our Terms of Use also apply to your use of the App. If there is a conflict between this Agreement and the Terms of Use as to your use of the App on an Apple device, this Agreement controls.

 

16. Termination

 

This license is effective until terminated by you or LunarLife, Inc. Your rights under this license will terminate automatically if you fail to comply with any of its terms.

 

17. Governing Law

 

This Agreement is governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules.
